By using drinkmullys.com (the “Site”) and buying our products (“Products”), you agree to these Terms of Service (“Terms”) and to the policies we link (Privacy, Refunds, Shipping, Age Verification).
1) Who Can Use Mully’s
- You must be 21+ to use the Site and purchase.
- We verify age and may cancel orders that don’t pass.
- You’re responsible for following your local laws.
2) Health & Safety
- Our Products and statements are not evaluated by the FDA and are not medical advice.
- If you’re pregnant, nursing, on meds, or have a condition/allergies, talk to a healthcare professional first.
- Drug testing: Hemp-derived THC items may lead to a positive test. Use at your own risk.
- Keep out of reach of children and pets.
3) Accounts
- Provide accurate info and keep your password safe.
- You’re responsible for activity on your account.
- We may suspend or close accounts at our discretion.
4) Orders, Pricing & Shipping
- An order is an offer; we accept it when we send a confirmation email.
- Prices can change; taxes/shipping shown at checkout.
- We can cancel or limit orders (fraud, availability, legal reasons).
- Risk of loss passes to you when we hand items to the carrier.

5) Acceptable Use
Don’t use the Site to break laws, infringe IP, harass others, send malware/spam, scrape, or bypass security. We may remove content or restrict access.
6) Your Content & Feedback
- If you post reviews or content, you grant us a worldwide, royalty-free license to use and display it per our Privacy Policy.
- You promise you have rights to what you post.
- Feedback/suggestions may be used without compensation.
7) Intellectual Property
The Site’s content and Mullys trademarks belong to us or our licensors. Don’t copy, sell, or reuse without permission (personal, limited use only).
8) Third-Party Links
We’re not responsible for third-party sites/services we link to. Use them at your own risk.
9) Communications (Email/SMS)
You may receive operational and promotional messages. Opt out anytime (e.g., STOP for SMS or unsubscribe links). Standard rates may apply.
10) Warranties & Liability (Plain-English Summary)
- The Site, Products, and Services are provided “as is.”
- We don’t promise they’ll be error-free, uninterrupted, or meet your needs.
- To the fullest extent allowed by law, we’re not liable for indirect or special damages (like lost profits or data).
- Our total liability for any claim won’t exceed the greater of $1,000 or what you paid us for the Product(s) involved in the claim in the past 12 months.
11) Indemnity
You agree to hold Mully’s harmless from claims arising from your use of the Site/Products, your content, or your violation of these Terms/laws.
12) Disputes, Arbitration & Class Waiver
- First, email us to try to resolve: legal@drinkmullys.com (30 days).
- If unresolved, disputes will be settled by binding arbitration with the AAA in Ashburn, Virginia (or by video).
- No class actions or jury trials. You and Mullys each bring claims individually.
- Claims must be filed within 1 year of when they arise.
13) Governing Law
These Terms are governed by Virginia law and applicable U.S. federal law.
14) Changes
We may update these Terms at any time by posting a new date. Continued use means you accept the changes.

Supplemental Terms — Wholesale
- Title and risk of loss transfer at carrier handoff.
- 30-day return window for items defective/damaged from us; other returns at our discretion.
- RMA required; unopened/original condition; you pay return shipping unless it’s our error.
- A $10 restocking fee may apply to shipped-order refunds.
- You’re responsible for legal resale and any required licenses.
